Terms of Use

These Terms of Use govern your use of the Forty5° mobile app, website (forty5d.com), and the workshop services we provide in Dubai, UAE (collectively, the "Service"). By creating an account, downloading the app, or visiting the workshop, you agree to these terms. If you don't agree, please don't use the Service.

1. Who we are

The Service is operated by Forty5° Motorcycles, a workshop based in Dubai, UAE. Contact us at contact@clubstyledubai.com for any question about these terms or about your account.

2. Your account

To use the app you need to create an account using your phone number and email address. You're responsible for keeping your login credentials safe; we'll treat anyone who signs in with your credentials as you.

You can delete your account at any time from Profile → Settings → Delete account. Deleting an account removes your bikes, bookings, and chat history. We may retain order and service history that's required for legal record-keeping (UAE tax and consumer-protection regulations require us to keep transaction records for a defined period).

3. Workshop services

Service prices shown in the app and on the website are estimates. Final pricing is confirmed in writing after the bike is inspected at the workshop. We will not begin paid work without your explicit approval of the final quote.

Where parts are required to complete a service, we either supply them from our catalogue or order them on your behalf. Lead times for ordered parts are quoted at booking time and can vary based on supplier and shipping conditions.

4. The Forty5° catalogue (Shopify-powered)

Parts and accessories are sold through our Shopify-powered storefront. Orders placed through the app or via Shopify checkout are governed by the Shopify storefront's own terms (delivery, refunds, returns) — not these app terms. We surface those terms inline at checkout.

5. AI Mechanic

The AI Mechanic is a chat-based assistant powered by Anthropic's Claude models. It answers questions about your motorcycle, our services, and related topics like ride weather. It is not a substitute for in-person diagnosis by a qualified mechanic. Do not act on its advice for anything safety-critical without confirming with a human at the workshop first.

Free-tier riders get up to 10 messages per day. Members get up to 100 messages per day plus access to additional capabilities — service-manual retrieval, error-code lookup, and AI-drafted bookings. Rate limits and capability tiers are set in the app and may change with notice.

6. Subscriptions (Forty5° Members)

Forty5° Members is an auto-renewing subscription sold through the Apple App Store and Google Play. The following terms apply:

• Auto-renewal: Subscriptions automatically renew at the end of each period (monthly or annually) unless you cancel at least 24 hours before the end of the current period.
• Cancellation: You can cancel any time by managing your subscription in your App Store or Google Play account settings. Cancelling stops the next renewal but you keep access until the end of the period you've already paid for.
• Free trial: If your account is eligible, you receive a 7-day free trial when you first subscribe. The subscription converts to paid at the end of the trial unless you cancel before the trial ends.
• Payment: All payment processing is handled by Apple or Google. Forty5° does not see or store your payment-card details.
• Refunds: Refunds are handled by Apple / Google per their store policies. We can't issue refunds for store-bought subscriptions directly.
• Pricing changes: If we change subscription pricing, we'll notify you in-app and via email at least 30 days before the new price applies. You can cancel before the change takes effect.
• Member perks: 10% off consumables (oil, filters, plugs, brake pads) applies automatically at Shopify checkout for tagged member customers. The free annual diagnostic resets every calendar year and must be redeemed in person at the workshop.

7. Acceptable use

You agree not to:

• Use the Service for anything illegal under UAE law.
• Attempt to extract data about other riders, our internal operations, or our infrastructure through the AI Mechanic or any other interface.
• Reverse-engineer, decompile, or attempt to bypass the app's security mechanisms.
• Use the AI Mechanic to generate content unrelated to motorcycles or our services.
• Resell, redistribute, or commercialise content from the Service without our prior written consent.

8. Intellectual property

The Forty5° name, logo, app design, and all original content are owned by Forty5° Motorcycles. Service-manual excerpts shown in the AI Mechanic remain the intellectual property of their respective manufacturers and are surfaced under fair-use principles for diagnostic assistance to the bike's owner.

9. Disclaimers

The Service is provided "as is" and "as available" without warranty of any kind, express or implied. Forty5° does not guarantee that the AI Mechanic's answers are correct, complete, or suitable for any particular purpose. Always confirm safety-critical decisions with a qualified mechanic.

We are not responsible for losses caused by service interruptions, third-party outages (Apple, Google, Shopify, Anthropic, RevenueCat, Supabase), or your reliance on AI Mechanic output.

10. Limitation of liability

To the fullest extent permitted by UAE law, Forty5°'s total liability for any claim arising from your use of the Service is limited to the amount you have paid to us in the 12 months preceding the claim.

11. Governing law

These terms are governed by the laws of the Emirate of Dubai and the federal laws of the United Arab Emirates. Any dispute that can't be resolved by good-faith discussion will be referred to the courts of Dubai.

12. Changes to these terms

We may update these Terms from time to time. When we do, we'll update the "Effective" date at the top of this page and notify you in-app for material changes. Continuing to use the Service after a change means you accept the updated Terms.
